1. Services
We provide custom WordPress development, website maintenance, content updates, lead tracking setup, and related support services. Specific deliverables, timelines, and fees are set out in a separate proposal or service agreement for each project.
2. User Representations
You represent that you have the authority to request services for the website in question, that any information you provide is accurate, and that you will not use the Site or Services for unlawful purposes.
3. Intellectual Property
Upon full payment, you own the final website design and content we create specifically for you, unless otherwise agreed in writing. We retain rights to pre-existing code, tools, themes, plugins, and processes we use across projects. You are responsible for ensuring you have the right to use any content, images, or trademarks you provide to us.
4. Payment and Cancellation
Project fees are set out in each proposal. Monthly maintenance plans are billed in advance and may be canceled with reasonable notice. Refunds are provided only where required by law or at our discretion.
5. Limitation of Liability
To the fullest extent permitted by law, Atlanta WordPress Developer is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Site or Services. Our total liability is limited to the amount you paid for the Services in the twelve months preceding the claim.
6. Indemnification
You agree to indemnify and hold harmless Atlanta WordPress Developer and its team from claims arising from your use of the Site, the content you provide, or your breach of these Terms.
7. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Atlanta, Georgia.
